PIP is mandatory for all registered vehicle owners in Florida, covering up to $10,000 in medical bills and losses from accidents, regardless of fault. However, insurance and healthcare providers often clash over economic interests, as demonstrated by this case.
The Case
Florida Hospital Medical Center sued Progressive Insurance Company for $200 in unpaid reimbursement for services provided to a policyholder injured in a car accident. The patient incurred $2,781 in hospital expenses, with a $1,000 deductible applied. The hospital calculated the amount due using Florida PIP law, but Progressive used a different method, resulting in an $868 payment. The $200 discrepancy, due to the deductible, led to the legal battle. The court ruled that insurers must apply the deductible to overall charges as per statutory provisions. This decision means insurers in Florida will have to pay more to hospitals and healthcare providers treating accident victims.
New Rule and Senate Action
The new rule mandates that the deductible be exhausted first. Statutorily, the minimum deductible is $1,000, which is the responsibility of the insured. Previously, insurers spread out the deductible. The US Senate is set to debate repealing Florida’s PIP law, which requires all registered vehicle owners to have personal-injury protection insurance. Enacted in 1972, the law aims to reduce lawsuits from accidents by covering medical expenses and lost income regardless of fault. The Senate will meet in January to decide the future of PIP coverage in Florida.
